Attorney: KU freshman linebacker seeking diversion on drunken-driving charge

A freshman Kansas University football player who faces a drunken driving charge has applied for diversion, his attorney said Tuesday.

Ben Heeney, 19, a linebacker from Hutchinson, was charged with DUI and racing on a highway after a Lawrence police officer pulled him over around 3:30 a.m. July 16 in the 700 block of West 23rd Street.

Defense attorney John Frydman said he expected Heeney’s case to be resolved once the diversion agreement with prosecutors is approved. Heeney was scheduled to appear Tuesday afternoon for a trial setting in Douglas County District Court, but Frydman said the defense was requesting a continuance based on the request for diversion. District Judge Kay Huff set Heeney’s next hearing for Oct. 18.

Kansas Athletics Inc. officials have said Coach Turner Gill was handling Heeney’s team discipline internally.
