The Carrier dome is not in NYC. Building a 60K seat AFH east in....Washington DC? That's probably the dumbest idea I have ever heard. You couldn't get 100 people in DC to read about KU basketball, let alone 60K to fill an arena. Average attendance for the Wizards last year was 16K and DC is definitely a pro sports town.

KU, Joe-College face new battle in lengthy legal contest

If this is really about lost royalties and scholarship money, why would the athletic dept. gamble $1.4 million in legal fees to win a few hundred thousand? It is about KU trying to protect its image, which is understandable to a point. However, this continued harassment is way past that point. Sorry Lew, but you don't get to tell all the KU fans what they can wear. If somebody prints a Luck Few shirt, I'd buy it!

Yes it is the precedent that is important here. But no it is not the correct one. I don't know all the precise details, like was he using KU logos, or other trademarks on the shirts? If not, there is no way that this case should have gone KU's way. Just because $$$ is part of the equation, doesn't take away the right to free speech. (see political speech and the inability to have any real limits on campaign spending). The only issue is whether he used trademarked or copywrited material without permission. No corporation, government, school, or anything else should be able to sue someone just because they are selling something they don't like. In short, you are wrong 100, bad job KU.
