KU football player cited for battery

A junior Kansas University football player was cited for battery in an early-morning incident Sunday at Tonic, 728 Massachusetts St., according to municipal court records.

Benjamin D. Heeney, 20, Hutchinson, faces one misdemeanor charge alleging he battered employees at the downtown club after they asked him to leave. He is scheduled to appear in court Feb. 8. In 2011, Heeney was granted diversion in a Douglas County DUI case.

If this is following a 2011 DUI then your time as a KU football player is done.

Not so Fasts!!! A charge of Battey is the weakest misdemeanor. It is just touching someone without their permission. The fact that the DA diverted or may divert, means he doesn't want to try the case...it may be weak, or be justified in some way...like 'self-defense'....and he doesn't want to deal with it.

Be calm. 'Post-O.J'.....many states and Kansas, made a charge...an automatic arrest...the police have very little discretion in these cases. Take it easy. The light charge, and if a quick diversion...all add up to ...no sign issue by legal issues ...esp in today's quick blame (post O.J. World) If it sounds liLike I know...been there, done that. Have a little faith in HCCW and DCDC..they know 'BS from 'Shinola' and so does AD Zenger. Sometimes, there are things that are not the public's or our business!! If it was your son, wouldn't you want to hear...'his side'. Then, why not Ben?

Your post is very hard to follow. Battery in NO state is a mandatory arrest. However, Domestic battery if evidence is present IS a mandatory arrest.

Crap, Ben Heeney? Dude is good. I blame him, I also blame the bouncers. Bouncers at clubs in Lawrence are....something I can't type.

Most likely.. It all depends on the actual report that is given and Weis will go from there I imagine. I would guess maybe 1 game suspension..

Judging from Ben's twitter account, Ben seems upbeat and on the team. For instance, he's been chatting back and forth with Jenk-Moore about the upcoming semester. If this happened Sunday, I'm assuming Weis already knows about it. I'm also assuming he'll be disciplined internally but remain on the team. Extremely stupid, yes. End of the world, no.

Sims got suspended for 3 games last year so I see no less of a penalty for Heeney. I don't see him getting kicked off the team though, but definitely suspended and probably around 2-3 games.

I like this kind of aggression and I think he stands for get out of my face and shut your piehole, this kind of aggression/attitude is what will win games at Ku and possible national championships. Its no doubt in my mind that this kid is a winner and can turn our program around. The rest the dudes the last few years have been whimps and not shown anything anyway so more power to the kid. Now take your punishment and fun 25 -100 yrd sprints and then run up and down those stairs at memorial stadium cause Charlie dont mess around with no BS. Take your punishment and you will be a better person/player in the long run.

Even if Heeney gets kicked off the team, we still should be fine at MLB next season with Faifili, Schyler Miles and Colton Goeas.

Ben Heeney is a key player for next year on our defense. When I attended KU as a student athlete, I found bouncers, students, and others who would like to push us any way they could trying to bait us into an altercation to test us to see if we are as tough as we think we are. After a while you get tired of it & then they put their hands on you: that's when all hell breaks loose. In the old days we usually settled any differences on the spot & everyone walked away. With today's laws and rules each coach has for his team, you have to know & abide with the coach's rules at all times. I always tried to walk away from an altercation but if I felt I had been pushed around too much or my honor was in the toilet, then the rodeo began. Obviously there are different opinions why there was an altercation involving Ben but Coach Charlie will work it out with him. That kid likes to make snot out of an opponate's face and football jersey...I like him! He will be fine.

Yeah, I think after this year Weis realizes just how screwed up this team is and he won't take Heeney off the team. He needs Heeney. Maybe in a few years when the team is 6-6 or 7-5 will he boot a player that has a fight in a bar.

He must go. Hate to judge because we all make mistakes. But this shows lack of discipline. It's his second incident. And it will set a poor example to keep him around. Hooligans and ruffians. Weis will have a platform to say no one is above the law and no one is bigger than the team.

If you're an athlete at any University, STAY OUT OF THE BARS PERIOD. There are people that are there just to start trouble with high profile individuals to get you off. Their motivations may not be right, but they'll do it. Just stay out of the bars, go to the Coffee Shop! There are people that just don't like college athletes. Can't get rid of them either.

Maybe you are all to young to remember back in the Good Ole Days when the likes of John Riggins was here and we were winning football games and players got into fights. This is not the end of the world. Part of the problem is some of you think these kids are perfect. They are not!!! is getting into a fight the end of the world NO. Was he right maybe not. But he will be punished by Charlie we can all be sure of that. Lets move on and win some games next year with TOUGH Football Players

Getting into a fight is not the end of the world. It may be the end of his career, or the better part of it anyway. At the least Heeney will be suspended a significant amount of games (this is now his 2nd offense). He wont be back until at least mid-season. By that point players will have established themselves in a rotation, and the LBs we have are good. And next year is his last. Heeney did this to himself. Stupid.

Not to mention, that Weis likes to give experience to underclassmen near the end of the season. They will need experience going into the season following. That's bad news for Heeney.

CITED for misdemeanor battery at a bar in Lawrence, and so many of you are saying Bye-Bye Ben???

You all are so quick to judge and condemn. Did you forget what it was like at bars in college? Football player gets in a fight with a Mass street bouncer during the offseason, who cares. Bad decision on Ben's part? Probably, but a tiny mistake to suggest kicking him off the team.

By the way, Ben Heeney ranked THIRD in the Big 12 in tackles this year. Like it or not, for something is minor as this, he is going nowhere!

This would have the potential to be a serious loss, as I firmly believe that 2013 is our year. But we need Big Ben if we are going to contend, and win, the Big XII (as I think we will do).

From now on, Ben, keep your nose clean.

I don't think this is a big deal at all. A lot of these comments about "He's done", come on, it's a misdemeanor. Hardly out of the norm for any college student. Suspension-maybe, Release-absolutely not. Not to mention I know this kid, met him in Hutch when he was in HS. He's a good kid.

We expect these kids to go out on the field and try to rip the head off the opposing team every down, but then be passive sheep off the field. Yes, there are a few instances of this but for the most part, the reason these kids are good is because they have a more aggressive nature than most. Since no details have been provided its all speculation at this point as to what happened and the public will probably never know.

The issue is more about poor judgement than the offense itself. Most all of us have found ourselves in a bar late at night in a situation that we should have avoided. Hopefully, after one instance most learn their lesson.

Weis will provide the appropriate punishment and hopefully we'll be praising Ben just like we did Sims this past fall.
