A Kansas University football player charged with his second D.U.I. could have to spend five days in jail.

Kick returner Greg Heaggans, 21, appeared in Douglas County District Court on Friday afternoon with his attorney.

Prosecutors charged Heaggans with one count of driving under the influence, stemming from his arrest Sept. 16 by the Kansas Highway Patrol.

Douglas County District Atty. Christine Kenney said this was the KU junior’s second D.U.I. offense. The sentence for a second-time D.U.I. offense is a mandatory five days in jail and a fine up to $1,000.

She said her office believed Heaggans entered into a diversion agreement on a D.U.I. charge in September, 2003, in Wyandotte County.

He is also on diversion in Douglas County after he was accused of stealing beer in November from a local convenience store.

Heaggans’ attorney entered a not-guilty plea for his client, and a judge set his next court date for Nov. 9.

Heaggans has not played since his arrest, and KU coach Mark Mangino confirmed he would not play today against Nebraska.
